Corbett said that following the introduction of Baycol in the United States in May 1998, Bayer allegedly learned that the risks associated with the drug were significantly greater than other similar drugs, particularly in higher doses or when Baycol was used in combination with another cholesterol- lowering drug. Corbett said that according to a multi-state consumer protection investigation, Bayer informed the U.S. Food and Drug Administration about the higher risks associated with Baycol, but Bayer allegedly failed to adequately warn consumers and doctors about potential problems, including a severe and potentially fatal muscle reaction that could cause kidney failure. "Consumers need clear and detailed information about the risks associated with various drugs so that they can make educated decisions about their health care," Corbett said. "This settlement ensures that Bayer will provide Pennsylvania residents and their doctors with the information they need to make well-informed choices about their medical treatment." Corbett said that Bayer does not admit any wrongdoing with this settlement, but does agree to register its relevant clinical drug trials and drug studies and to post the results at the end of each study. Information and links to the drug studies will be posted on the Bayer website as well as various Internet sites dealing with drug study information, including ClinicalTrials.gov and ClinicalStudyResults.org. Corbett said that Bayer is also prohibited from making false or misleading claims in the future marketing, promotion and sale of its products, and is required to pay $8 million to the 30 states for future consumer protection and enforcement programs. Pennsylvania will receive $600,000 from the settlement. Corbett noted that this multi-state settlement will not impact various private legal actions filed against Bayer involving Baycol. Bayer voluntarily withdrew Baycol from the market in August 2001. In addition to Pennsylvania, the settlement includes Arizona, Arkansas, California, Connecticut, Delaware, Florida, Idaho, Illinois, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Mississippi, Montana, Nevada, North Carolina, Ohio, Oregon, South Carolina, South Dakota, Tennessee, Texas, Vermont, Virginia, Washington and Wisconsin. The settlement was filed today in Commonwealth Court by Chief Deputy Attorney General Thomas M. Devlin of the Attorney General's Health Care Section.
